On Form 4473 the question is "Are you an
unlawful user...". If you are in the IND program, the answer is NO, regardless of the "Warning". However, you could argue that the people in the program are "addicted", which is the second part of the question. They, in turn, could argue that marijuana doesn't usually create a physical addiction.
